The petitioner apprehends his arrest in Basopatti P.S. case No. 198 of 2016 for the offences punishable under Section 307 and some other Sections of the Indian Penal Code, under Section 27 of the Arms Act and under Section 3⁄4 of Explosive Substance Act.

The prayer of petitioner for anticipatory bail was earlier rejected by this court vide order dated 11.07.2017 passed in Cr. Misc. No. 18263 of 2017.

Sri Murari Narain Choudhary, the learned counsel for the petitioner, submits that case of petitioner stands on same footing as that of Babloo Thakur, petitioner No.7 of Cr. Misc. No. 18263 of 2017, who has been allowed anticipatory bail, and now

Patna High Court Cr.Misc. No.62163 of 2017 (2) dt.21-02-2018 2/2 the case has been compromised, hence, the petitioner may also be enlarged on anticipatory bail but from perusal of the records, I find that after considering all the facts the prayer for anticipatory bail of petitioner was rejected.

I do not find any new facts to reconsider the prayer of petitioner for anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below and pray for regular bail, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from the order of this court. (Prabhat Kumar Jha, J) BKS/- U T
