The petitioners seek bail in connection with Atri P.S. Case No. 138 of 2022 dated 13.04.2022 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504 and 506 of the Indian Penal Code. As per the prosecution case, petitioners alongwith the other co-accused persons named in the FIR attacked the members of prosecution party making them injured. The genesis of occurrence is a dispute due of flow of drainage water of the informant from the door of the accused petitioners. Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.30661 of 2023(2) dt.14-06-2023 2/2 petitioners have not committed any crime and are neighbours, there is case and counter case between the parties for the same occurrence. The petitioners are in judicial custody since 06.08.2022, having no criminal antecedent.

Learned APP appearing for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, let the petitioners above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIII, Gaya in connection with Atri P.S. Case No. 138 of 2022.
