The petitioner seeks bail in a case registered under Sections 387, 307, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that the accused persons demanded ransom from the informant on mobile with threatening of dire consequences on non-payment of ransom amount and the same demand was repeated twice. It is also alleged that in the school campus, firing was made. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-04-2018. Charge sheet has already been submitted. The petitioner has been

Patna High Court CR. MISC. No.27218 of 2019(4) dt.09-07-2019 2/2 falsely implicated in the present case. None of the mobile numbers as indicated in the FIR belongs to the petitioner. It is further submitted that the petitioner shall cooperate in the trial. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R and he has criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari in connection with Raxaul P.S. Case No. 216 of 2017.

Further, the petitioner is directed to appear in the court below on each and every date fixed in the case. If, he makes himself absent on two consecutive dates, the court below shall be at liberty to cancel the bail bond of the petitioner. (Sudhir Singh, J) A.K.V.//- U T
