JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 27-08-2025 Out of submission and perusal of record, it appears that out of seven prosecution witnesses, five prosecution witnesses were already examined by the learned trial court. The petitioner remains in custody since 03.11.2024.

2. It is pointed out by learned counsel appearing for the informant that next date of proceeding before learned trial court is 04.09.2025 and only two official prosecution witnesses i.e. Investigating Officer and doctor are remained to be examined.

3. Considering the aforesaid aspect, after short argument, learned counsel appearing for the petitioner seeks permission to withdraw the present petition, with liberty to

Patna High Court CR. MISC. No.28017 of 2025(6) dt.27-08-2025 2/2 renew his prayer of bail in case of non-examination of remaining prosecution witnesses after three months.

4. In view of above, the present petition stands dismissed as withdrawn, however, with liberty to renew prayer of bail after three months, if so advised, in case of non-examination of prosecution witnesses, as discussed aforesaid.

5. Let a copy of this order be sent to the Senior Superintendent of Police, Gaya to ensure the examination of Investigating Officer and doctor of this case positively on next date of proceeding i.e. on 04.09.2025.
