The present application has been filed for quashing the order dated 2.5.2016 passed by the learned 12th Additional Sessions Judge Motihari in S.T. No. 608 of 2011 arising out of Madhuban P.S. Case No. 54 of 2010 whereby the petitioner's application for discharge under section 228(1)(a) Cr.P.C. has been rejected.

Learned counsel for the petitioner very fairly submits that charges have been framed but the trial has not concluded.

In the circumstances, in view of the changed stage of the proceeding, this application is disposed of with a liberty to the

Patna High Court Cr.Misc. No.25678 of 2016 (2) dt.24-05-2017 2/2 petitioner to raise all contentions at the appropriate stage of proceeding.
