The petitioner is apprehending his arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code. Prosecution case is that on 15.10.2015 at 6.00 PM when the informant was at her house then the petitioner Kamlesh Rajbanshi started assaulting with fists and slaps to her brother-inlaw Jitendra Rajbanshi and subsequently, the petitioner caused injury with spade on the head of the husband of the informant, Balmukund Rajbanshi.

It is submitted by the learned counsel for the petitioner that for a petty dispute the accusation has been levelled. Though the injury on the head of the husband of the informant has been found to be grievous but the petitioner is alleged to have caused

Patna High Court Cr.Misc. No.25358 of 2016 (2) dt.22-06-2016 injury with spade and the other injuries were found to be simple in nature caused by hard and blunt substance.

Considering the accusation being supported by the medical report coupled with paragraph 3 of the application that the petitioner has no criminal antecedent, it is a fit case for consideration of regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Govindpur P.S.Case No. 96/2015 (G.R.No. 3002/2015) pending in the court of Chief Judicial Magistrate, Nawada.

With the aforesaid observation, this application is disposed of.
