The petitioners seek bail in a case registered under Sections 20(b)(II)(c)/22 of the N.D.P.S. Act. Prosecution case, in short, is that 20 kg ganja is recovered.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 19.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. 20 kg ganja is alleged to have been recovered. The alleged recovery is not more than the
Patna High Court CR. MISC. No.26265 of 2019(2) dt.23-04-2019 2/2 commercial quantity. There is no compliance of Sections 42 and 50 of the N.D.P.S. Act. Other co-accused has been granted bail vide Cr.Misc.No.22459 of 2019.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Spl. Case No.02 of 2019 arising out of Chandan P.S. case No.09 of 2019. (Sudhir Singh, J) Narendra/- U T
