The petitioner seeks bail in connection with Manigachhi P.S. Case No. 50 of 2020 dated 20.02.2020 instituted for the offences under Sections 302, 201 and 34 of the Indian Penal Code.

The petitioner is said to be in custody since 22.02.2020.

The informant, who is the son of the deceased has alleged that his late father was troubled and harassed by his second wife and sons born out of the second marriage. Later, while remaining in Delhi, he learnt that the deceased was assaulted, killed and thereafter was hung from a tree to give it a colour of

So far as the petitioner is concerned, he is said to be a co-villager having sympathy with the step brothers of the deceased born out of the second marriage of his late father with one Lal Biwi. The investigation reports also do not indicate any statement having been made by any eye witness to the occurrence. The post-mortem report reveals that the death is because of hanging.

Regard being had to the facts that the petitioner is only a co-villager and the accusation is basically in the realm of suspicion, this Court is inclined to grant bail to him.

The petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VII, Darbhanga in connection with Manigachhi P.S. Case No. 50 of 2020.
