The petitioners are apprehending arrest in a case registered for the offences punishable under sections 120B,406,419,420,504 and 506 of the IPC.

The prosecution case is that petitioner no. 1 is the maternal father-in-law of the informant. Petitioner no. 1 Chhotelal Singh fixed the performance of second marriage of his son namely Bhavesh Kumar on 7.4.2017, meanwhile, the first wife of his son appeared at the marriage scene, upon which the baraat was taken as hostage by the bridal side. The informant, on the request made by petitioner no. 1, arranged Rupees Five lacs Twenty Thousand which was paid to the proposed bride's father

Patna High Court Cr.Misc. No.61623 of 2017(2) dt.20-12-2017 2/2 and only then the hostage were released. When the informant asked for returning the money which he had paid, he was threatened by petitioner no.1.

It is submitted by learned counsel for the petitioners that the in order to blackmail the petitioners and since the son of petitioner no. 1 has filed a matrimonial suit for restitution of conjugal rights, a concocted case has been lodged. There has never been a marriage nor there is any payment by the informant.

Considering the nature of accusation and the submissions of learned counsel for the petitioners, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Bhagalpur in connection with Shahkund (Sajour) P.S. Case No. 138 of 2017.
