The petitioner seeks bail in Kundwa Chainpur P.S. Case No.114 of 2019 registered under Sections 272, 273 of the Indian Penal Code and under Sections 30(a) and 41(1) of Bihar Prohibition and Excise Act.
The informant, during the course of vehicle checking, intercepted the vehicle and apprehended Mintu Kumar. From the motorcycle of Mintu Kumar, 18 litres Nepali liquor was recovered. From the motorcycle of the petitioner, 27 litres Nepali liquor was recovered.
The learned counsel for the petitioner submits that for the recovery of 27 litres of liquor from the motorcycle of the petitioner, the petitioner is in jail since 20.08.2020. Petitioner
Patna High Court CR. MISC. No.25057 of 2020(2) dt.21-09-2020 2/2 remained in jail for about one month. Petitioner has got no criminal antecedent.
Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional District and Sessions Judge-cum-Special Judge, Excise, East Champaran, Motihari in connection with Kundwa Chainpur P.S. Case No.114 of 2019.
