2. The petitioner in this case is seeking pre-arrest bail in connection with Patrakar Nagar P.S. Case No. 884 of 2023 registered for the offence punishable under Section 379 of the Indian Penal Code. He has got two criminal antecedents.
3. As per the prosecution story, on 26.11.2023 at about 10:30 A.M., one staff of the informant came to his residence on a bicycle and after half an hour, when he was about to return, he did not find his bicycle. It is alleged that from the CCTV footage, the informant came to know that this petitioner has stolen the bicycle.
4. Learned counsel for the petitioner submits that the petitioner and the informant are co-sharers and there is a land dispute between the parties. It is further submitted that the
Patna High Court CR. MISC. No.32005 of 2024(4) dt.06-06-2024 2/3 petitioner is a practicing Advocate of this Court and on earlier occasions also, the informant has lodged similar kind of cases against the petitioner.
5. Learned APP for the State has opposed the anticipatory bail of the petitioner.
6. Having regard to the submission that the petitioner and the informant are co-sharers, there is a land dispute because of which the present case has been lodged alleging that the petitioner had indulged in committing theft of a bicycle whereas the petitioner is said to be practicing Advocate of this Court and on earlier occasion also, the informant has lodged similar kind of cases against the petitioner in which he has been granted anticipatory bail, this Court directs that in case of his arrest or surrender within a period of four weeks from today, the petitioner above-named shall be released on bail in connection with Patrakar Nagar P.S. Case No. 884 of 2023 on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
7. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at

No.32005 of 2024(4) dt.06-06-2024 3/3 any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
