JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner, apprehending his arrest in connection with Goh P.S. Case No. 02 of 2015 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code, seeks the privilege of pre-arrest bail.

Allegedly, Nitu Devi, the daughter of the informant, was married to Surendra Paswan, son of Ramjivan Paswan, and thereafter all the accused persons including the petitioner killed his daughter.

Submission is of false implication and that the deceased was married with Surendra Paswan eight years ago, the petitioner is Devar and there is no specific allegation against him. The

Patna High Court Cr.Misc. No.3693 of 2017 (2) dt.13-02-2017 2/2 allegations are omnibus in nature. The husband is already in custody, in this case mother-in-law and sister-in-law have already allowed pre-arrest bail vide Criminal Miscellaneous No. 16264 of 2016 by another coordinate Bench of this Court and as such, the petitioner also deserves sympathetic consideration. Learned A.P.P. fairly submits that the two co-accused have allowed pre-arrest bail.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Goh P.S. Case No. 02 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Jitendra Mohan Sharma, J) Vats/- U T
