This application for anticipatory bail, arises out of Khanpur Police Station Case No. 03 of 2019, disclosing offences punishable under Sections 147, 148, 149, 307, 323, 324, 325, 341 and 504 of the Indian Penal Code. It appears from the First Information Report that occurrence, if any, had taken place because of a speed breaker on a road, present in front of the house of the petitioner. The informant wanted to get the said speed breaker removed, whereafter the scuffle ensued and occurrence appears to have taken place. There is allegation of assault made by lathi and sharp cutting weapon. The informant and others are said to have

Learned counsel for the petitioner has submitted that the injuries have been found to be simple in nature. Considering the genesis of occurrence, this application is allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur, in connection with Khanpur Police Station Case No. 03 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
