The petitioner seeks bail in connection with Muffassil Lakhaura P.S. Case No. 743 of 2018, registered for offence punishable under Section 379 of the Indian Penal Code and Sections 135 and 138 of the Indian Electricity Act, 2003. Learned counsel for the petitioner submits that the petitioner is ready deposit the amount of Rs. 1,10,000/-, which is loss amount of the Power Company in 06 (six) equal installment.
Considering the facts and circumstances of the case and above submission, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.39129 of 2021(2) dt.19-05-2022 2/2 satisfaction of the learned Special Judge (Electricity) NBPDCL, Tirhut area, Muzaffarpur in connection with Lakhaura P.S. Case No. 743 of 2018 subject to the condition that the petitioner will deposit the loss amount Rs. 1,10,000/- in 06 (six) installments in the power company. After deposit of first installment, the petitioner will produce the receipt of payment to the court below, thereafter the court below shall release the petitioner on provisional bail for 06 (six) months and after payment of entire amount of Rs. 1,10,000/- by the petitioner to the power company the bail of the petitioner shall be confirmed by the court below.
