JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-10-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the parties.

Though, the present writ petition has been filed for setting aside the order dated 10.09.2018 passed by the SubDivisional Officer, Sonepur, Saran at Chapra, whereby and where under the P.D.S. license of the petitioner bearing License No.81 of 2016 has been cancelled, but during course of hearing it has been submitted that the petitioner has already filed an appeal bearing Supply Appeal No. 40 of 2018 before the District

Patna High Court CWJC No.12396 of 2021(2) dt.01-10-2021 2/2 Magistrate, Saran at Chapra, however, the same is not being disposed of, hence, some direction be issued so that the appeal of the petitioner can be disposed of at an early date. The Ld. Counsel for the Respondent State, Shri Alok Ranjan, AC to AAG-5 submits that the appeal of the petitioner would definitely be disposed of expeditiously. Having regard to the facts and circumstances of the case, the District Magistrate, Saran at Chapra is directed to dispose of the aforesaid pending appeal of the petitioner bearing Supply Appeal No. 40 of 2018 within a period of six weeks from the date of receipt/ production of a copy of this order, in accordance with law, if not already disposed off. The writ petition stands disposed off with the aforesaid directions.
