The petitioners apprehend their arrest in connection with Alauli P.S. Case no. 223 of 2017, registered under Sections 363 and 366A of the Indian Penal Code.

The accusation is that in the evening of 26.06.2017, the daughter of the informant had gone to attend the call of nature, but she did not return. The informant raised suspicion about enticing away of his daughter by Rajaram Yadav with the help of 9 accused named in the F.I.R. including the petitioners.

Learned counsel for the petitioners submits that, in fact, due to love affair, the daughter of the informant left her parental house

Patna High Court Cr.Misc. No.54643 of 2017 (2) dt.16-11-2017 2/2 with Rajaram Yadav according to her sweet will and performed marriage with him, but with ulterior motive, this case has been lodged. Further submission is that the statement of the victim is recorded under section 164 Cr.P.C. in which she stated about calling of Rajaram Yadav and moving and performing marriage with him. The victim has also expressed her desire to live with Rajaram Yadav as husband and wife, which would appear from Annexure-2.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 223 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
