JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2016 Heard Sri Anand Kumar Bhaskar, learned counsel for the petitioner and Sri Amrendra Prasad, learned A.P.P. The sole petitioner, apprehending his arrest in connection with Garkha P.S. Case No. 72 of 2016 registered for the offence under Section 147, 149, 341, 323, 325, 379 , 307 of the Indian Penal Code has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that it was a counter blast to the case registered from the petitioner's side. He submits that from the petitioner's side prior to this F.I.R. an F.I.R. vide Garkha P.S. Case No. 68 of 2016 was lodged. He further submits that injury report which has been brought on record also does not support the prosecution case. Learned A.P.P. by way of referring to the F.I.R. submits that in the F.I.R. there is specific accusation against the
Patna High Court Cr.Misc. No.26528 of 2016 (2) dt.01-07-2016 2/2 petitioner himself.
In view of the fact that there is specific accusation in the F.I.R., I do not find any ground to extend the privilege of anticipatory bail.
The petition stands dismissed.
