Petitioner apprehends his arrest in connection with Maner P.S. Case No.358 of 2018 for the offence punishable under Sections 365, 363/34 of the Indian Penal Code. The allegation against the petitioner, as mentioned in the FIR is that the petitioner along with other persons abducted / kidnapped the daughter of the informant, Sneha Kumari, aged about 16 years.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and the daughter of the informant was in love with the petitioner and she has married with the petitioner on her freewill. Learned counsel further submits that from perusal of Annexure-2, which is statement under Section 164 Cr.P.C., it would be evident that the victim girl, after being recovered, has stated that

Patna High Court CR. MISC. No.33782 of 2019(2) dt.31-07-2019 2/2 she had gone with the petitioner voluntarily and has performed marriage with the petitioner at Patna Court. Learned counsel further submits that girl is major, as would be evident from Annexure-3 which is Aadhar Card of the victim girl. After having heard learned counsel for the petitioner as well as learned counsel appearing on behalf of the State and taking into consideration the fact that the girl has voluntarily left the house of her father and has performed marriage with the petitioner and as per the Aadhar Card, the age of the girl is 19 years, as such, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Danapur, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
