JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 10-04-2018 This appeal has been filed by the appellant Ram Bilash Yadav, son of Sitaram Yadav, resident of VillageDumaraon, P.S.-Adhaura, District-Kaimur (Bhabhua) challenging his conviction for offence under Sections 302/34, 364 and 201 of the Indian Penal Code vide order dated 27.05.1995 passed by learned 3rd Additional Sessions Judge, Kaimur at Bhabua in Session Trial No.122 of 2001/1990 of 1995. Challenging the same conviction the same appellant Ram Bilash Yadav along with coaccused Shyam Lal Yadav and Lalita Yadav has also filed Cr.Appeal (DB) No.198/1995.

As the appellant Ram Bilash Yadav has filed two appeals challenging his conviction by same order dated 27.05.1995, we permit him to prosecute first appeal filed i.e.

Patna High Court CR. APP (DB) No.211 of 1995 (4) dt.10-04-2018 Cr.Appeal (DB) No.198/1995 along with co-accused Lalita Yadav and Shyam Lal Yadav (since dead) and dispose off the Cr.Appeal (DB) No.211 of 1995 with the aforesaid liberty. (Rajendra Menon, CJ) (Rajeev Ranjan Prasad, J) Arvind/- U
