The petitioner is apprehending his arrest in connection with Budha Colony P.S. Case No. 55 of 2018, registered for the offences punishable under Sections 147, 148, 149, 323, 341, 324, 307, 379, 504 and 506 of the Indian Penal Code. Allegation against the petitioner and other accused persons of entering into the house of the informant and assaulted him.

Submission of learned counsel for the petitioner is that the allegation of assault is against one Sunil Kumar Pandey and there is no allegation against this petitioner. He has no criminal antecedent.

Heard learned APP also.

No.32681 of 2018 (2) dt.28-06-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, XVI, Patna, in Budha Colony P.S. Case No. 55 of 2018, subject to conditions as laid down under section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
