In this case, the petitioners are seeking anticipatory bail in connection with Uchakagaon P.S. Case No.45 of 2019, registered for the offence punishable under Sections 341, 342, 307, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation has been made that when the informant was returning home by Motorcycle with her relative Baliram Kumar from Bazar, four persons on two motorcycles overtook and encircled them and the petitioner no.1 started assaulting her with fists and slaps hurling abuses and co-accused Nanadlal Singh, petitioner no.2 and one unknown person started assaulting, whereas, Nandlal Singh resorted firing on her, which caused injury and petitioner no.2 Sugriv Singh took out gold

Patna High Court CR. MISC. No.28272 of 2019(2) dt.30-04-2019 2/2 chain from her neck and threatened her not to ask share of 3 dhurs land and, thereafter, they fled away towards the village by their motorcycle.

Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-9, Gopalganj in connection with Uchakagaon P.S. Case No.45 of 2019 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
