The petitioner seeks bail in connection with Phulwari Sharif P.S. Case No. 318 of 2023 registered for the offence punishable under Sections 323, 307, 498A / 34 of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act. As per the prosecution case, the allegation against the petitioner who is husband of the victim alongwith his family members used to torture the informant for dowry demand and assaulted her by leg causing injury on her abdomen and chest. Learned counsel for the petitioner submits that petitioner is husband of the victim wife who never demanded

Patna High Court CR. MISC. No.30460 of 2023(2) dt.13-06-2023 2/2 any dowry from his wife and the allegation is general and omnibus in nature and the petitioner is in jail custody since 01.03.2023 having no criminal antecedent. He is ready to keep his wife with honour and dignity.

Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna in connection with Phulwari Sharif P.S. Case No. 318 of 2023.
