JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 19-05-2025 Heard Mr. Niranjan Parihar, learned counsel for the petitioner, Mr. Ajay Kumar Jha, learned counsel for the informant and Mr. Suresh Prasad Singh, learned APP for the State.
2. The petitioner has prayed for bail in connection with Kharagpur P.S. Case No. 143 of 2024 registered for the offence punishable under Sections 341, 323, 324, 307, 302, 504, 147, 148, 149 and 120(B) of the Indian Penal Code.
3. The case of the prosecution is that the petitioner along with others have some trivial dispute between the parties, arrived and stopped the husband of the informant from making Bhushari. It is also alleged that Dashrath Das called his family members, after that, the family members arrived and

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. It is also submitted that the nature of allegation is general and omnibus and from perusal of the postmortem report it transpires that the deceased was having only one stitch wound. There is allegation that all the accused persons who are ten in number have assaulted the deceased with lathi-danda but only one injury was found on the person of the deceased. The allegations does not co-relate with the ante-mortem injuries of the deceased. Similarly situated other co-accused persons have already been granted bail by this Court vide order dated 26.03.2025 in Cr. Misc. No. 81947 of 2024. Moreover, the petitioner is languishing in judicial custody since 05.02.2025.
5. Learned APP appearing for the state and learned counsel for the informant have opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court

The above named petitioner is directed to be released on bail in connection with Kharagpur P.S. Case No. 143 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II, Munger. (Ashok Kumar Pandey, J) lata/- U T
