This is an application for grant of anticipatory bail in connection with Kalyanpur PS case no. 36 of 2017 registered for the offences punishable under Sections 304B, 120B of Indian Penal Code.
The allegation is regarding the accused persons causing the death of the victim girl on account of non-fulfiment of demand of dowry.
The learned counsel for the petitioners submits that the husband is in custody and as far as the petitioners herein are concerned, they are brothers of the husband of the deceased lady.
Patna High Court Cr.Misc. No.62653 of 2017 (3) dt.12-01-2018 It is further submitted that general and omnibus allegation have been leveled against the petitioners and no specific role has been assigned to the petitioners herein so as to connect them with the alleged incident of dowry death.
Having regard to the facts and circumstances of the case, the abovenamed petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Kalyanpur PS case no. 36 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
