====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 28-06-2018 Heard Sri Raj Kishore Singh, learned counsel for the petitioner and Sri Shailendra Kumar no.1, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Case No.16 ( C ) 2 of 2018 registered for the offence under Sections 30(a), 32(i), 32(3), 38(i), 41(i), 42(2) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender.
Learned counsel for the petitioner submits that in this case, nothing was recovered from the conscious possession of the petitioner, rather in the case, recovery was affected from a field of one another person and the petitioner has falsely been implicated in the village politics. He further submits that the

Considering the nature of accusation as well as the fact that the petitioner is having clean antecedent, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Gaurav Kumar be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-II-cum- Special Judge, Excise, Lakhisarai in connection with Case no.16( C) 2 of 2018, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
