====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Patepur P.S. Case No. 56 of 2020 registered for the offences punishable under Sections 147/148/149/323/341/427/ 307/153/188/333/332/353/504of the Indian Penal Code. As per the prosecution case, on 02.04.2020 at about 09:00 a.m., the informant along with other police officials reached at the house of co-accused Baijnath Paswan. It is alleged that Baijnath Paswan and his wife threw bricks and stones on the police personnel. It is further alleged that all the accused persons including these petitioners came armed with

Patna High Court CR. MISC. No.29019 of 2020(2) dt.02-12-2020 2/2 Lathi and Danda damaged the government vehicle and tried to snatch the arms from the police personnel.

It is submitted that general and omnibus allegations have been levelled against these petitioners. Petitioners have got no criminal antecedents as stated in paragraph No. 3 of the petition. It is further submitted that similarly situated coaccused persons have already been granted bail by this Court vide order dated 08.10.2020 passed in Cr. Misc. No. 24639 of 2020.

In view of the aforementioned facts and circumstances, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, III, Vaishali at Hajipur, in connection with Patepur P.S. Case No. 56 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Prabhat Kumar Singh, J) Saif/- U T
