The petitioners apprehend their arrest in Ishmailpur P.S. Case No. 13/2016, registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code. The informant alleged that his daughter had gone to Navgachhia college but she did not return. He alleged that Billa Mandal @ Amresh Kumar kidnapped his daughter with the help of the petitioners.
It is submitted that the petitioners are father and mother of Billa Mandal @ Amresh Kumar. The victim made her statement under Section 164 of the Cr.P.C. and she disclosed that she went herself with Billa Mandal @ Amresh Kumar and
Patna High Court Cr.Misc. No.26538 of 2016 (4) dt.24-08-2016 2/2 solemnized marriage with him. Nobody kidnapped her. Considering the facts aforesaid and the fact that the victim herself denied to have been kidnapped and she solemnized marriage with the son of the petitioners, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
