13-06-2018 Heard Sri Raghav Prasad, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Raghunathpur P.S. Case No. 50 of 2018 registered for offence under Sections 272, 273, 308/34 of the Indian Penal Code and Sections 30(A), 38(A)/41(i) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. It has been argued that save and except confessional statement of the co-accused, there is no other material to connect the petitioner in the present case.
Patna High Court Cr.Misc. No.32992 of 2018(2) dt.13-06-2018 2/2 Learned Addl. Public Prosecutor has opposed the prayer for grant of bail.
Considering the fact that petitioner is having clean antecedent and the fact that his name has come in confessional statement of the co-accused, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Raghaw Yadav @ Radhav Kumar Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Siwan in connection with Raghunathpur P.S. Case No. 50 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
