Petitioner apprehends arrest in connection with Pakridayal P.S. Case No. 163 of 2018 registered for the offence punishable under section 409 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been implicated in this merely on wrong facts. The amount of crop insurance is to be given to the Kisan Credit Card holders who are account holders of the Bank. On the written instructions of the Regional Manager and other Higher Officials, he had transferred the money in the Kisan Credit Card Holders. In this matter,

Patna High Court CR. MISC. No.28503 of 2019(2) dt.02-05-2019 2/2 petitioner was suspended from service and departmental enquiry was initiated. Thereafter internal Audit and inspection was made in which no irregularity was found as is evident from Annexure-2. Later on, the suspension of the petitioner has been revoked and he has been reinstated in service vide Annexure-3. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, V, Motihari, East Champaran in connection with Pakridayal P.S. Case No. 163 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
