Case No. 55 of 2018, dated 19.03.2018, instituted for the offences punishable
Patna High Court Cr.Misc. No.33221 of 2018 (2) dt.03-07-2018 2/3 under Sections 147, 148, 149, 323, 324, 307, 504 and 506 of the Indian Penal Code.
The petitioners are said to have assaulted the informant and others by means of hard blunt substance. No reason has been assigned in the F.I.R. about the occurrence. Learned counsel for the petitioners, however, has submitted that the false implication is because of an earlier litigation with the informant with respect to a proceeding under Section 147 of Cr.P.C. The petitioner No. 1 had earlier filed a case against the informant as well, the detail of which has been provided in the petition and the F.I.R. has been annexed as Annexure-3. It has further been submitted that the injuries suffered by the informant have been opined to be simple in nature.
All this apart, it has been argued, now the informant has chosen to effect a settlement with the petitioners and has given a declaration that he does not wish to prosecute them any further.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the
