The petitioner apprehends arrest in a case registered for the offence punishable under sections 402/34 of the Indian Penal Code and section 7 of the EC Act.

Learned counsel for the petitioner submits that the petitioner is owner of the tractor from which 96 bags of rice have been seized which was to be used for black marketing. Petitioner submits that the rice in question had been purchased by the petitioner from the shop, as such offence under the aforesaid sections are not attracted against the petitioner. Owner of the rice has also filed a petition under section 457 of the Cr.PC in the Court below for release of rice. Petitioner has got no criminal antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in Danapur Police Station Case No. 158 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
