====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-12-2020 Heard learned counsel for the petitioners and the State through Video Conferencing.

Petitioners apprehend arrest in a case registered for the offence punishable under Sections 147, 148, 149, 504, 506, 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on 22.03.2020 at about 1:00 PM 40 to 50 criminals including 24 F.I.R. named persons came to the house of the informant and it is alleged that coaccused Vidhyanand Yadav, Dilip Yadav and Mahendra Yadav instigated to kill upon which co-accused, Koslendra Yadav dragged Shankar Yadav and sought him dead with his pistol.

No.29119 of 2020(2) dt.03-12-2020 2/2 It is submitted on behalf of the petitioners that Petitioner No.1 is father and Petitioner No.2 is son of the Petitioner No.1 and no specific overt act has been alleged against these petitioners. Petitioners have got clean antecedent as stated in paragraph no.3 of the petition.

Learned counsel for the State, on the other hand, opposes the prayer for bail.

In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. In the event of arrest/surrender, let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate-V, Darbhanga in Manigachhi (Bajitpur O.P.) Police Station Case No. 74 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
