Mr. Asharaf Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 3.
23-03-2018 Heard Sri Manish Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Keoti P.S. Case No. 84 of 2017 registered for offence under Sections 394 and 364 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.
It was submitted by learned counsel for the petitioner that F.I.R. was lodged against one Vikram and other two unknown persons, however; during investigation, co-accused Vikram was arrested and on the basis of his confessional statement, petitioner's name has surfaced. According to learned counsel for the petitioner, the confession made before the police is not admissible and as such, petitioner deserves to be enlarged on bail.
Patna High Court Cr.Misc. No.5257 of 2018(3) dt.23-03-2018 2/2 Considering the fact that informant in his fardbeyan has categorically stated that he can identify the accused persons, if they are shown to him, and particularly the fact that in this case, road robbery was committed and one accused has already been arrested and investigation is still going on, there is no reason to pass favourable order.
Dismissed.
