JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Muzaffarpur Town P.S. Case No. 133 of 2018 dated 24.02.2018 instituted for the offences under Sections 420, 406, 467, 468, 471, 120(B) of the Indian Penal Code. A plot of land was sold to the informant in the year 2010 which ultimately was found to be not belonging to the vendor. The petitioner is alleged to have shown that land to the informant for the purposes of the same being purchased. The learned counsel for the petitioner has submitted that the sale deed was executed in the year 2010 but the F.I.R. has been lodged on 22.02.2018 i.e. after eight years. Patna High Court Cr.Misc. No.33521 of 2018 (2) dt.03-07-2018 2/2 relationship also exists between them. A complaint case vide Complaint Case No. 96 of 2015 is also pending with respect to the same plot of land in which the petitioner has been made a witness.

Considering the aforestated facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 133 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
