This application for anticipatory bail, arises out of Hulasganj Police Station Case No. 07 of 2017, disclosing offences punishable under Sections 304(B)/34 of the Indian Penal Code.

The petitioner no. 1 is the father-in-law and the petitioner no. 2 is the mother-in-law of the deceased. Petitioner no. 3 is the daughter of petitioner nos. 1 and 2. Learned counsel, appearing on behalf of the petitioners, has submitted that the police, upon completion of investigation, has submitted charge sheet, though there is no concrete material to suggest that the petitioners ever raised any

Patna High Court CR. MISC. No.29040 of 2019(2) dt.02-05-2019 2/2 demand of dowry or tortured the victim. It has also been argued that the deceased died of electrocution, as is mentioned in the First Information Report also.

In view of the above submission, this application is allowed.

Let the petitioners, above-named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jehanabad, in connection with Hulasganj Police Station Case No. 07 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
