JUSTICE PURNENDU SINGH ORAL ORDER 20-11-2024 Heard Mr. Vivekanand Singh, learned counsel appearing on behalf of the petitioners; Mr. Bimal Kumar, learned counsel appearing on behalf of the informant and Mr. Bishweshwar Ram, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Katihar Town P.S. Case No. 18 of 2023, registered for the offence punishable under Sections 341, 323, 504, 506/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

3. It is informed by the parties that they have resolved their dispute on the mutually agreed terms and conditions entered into between them on 19.09.2024 and today, in terms of

Patna High Court CR. MISC. No.31868 of 2024(4) dt.20-11-2024 2/3 condition no. 2 of the Memorandum of Agreement dated 19.09.2024, the petitioner has handed over a Demand Draft bearing no. 767555 of Rs. One Lakh Fifty Thousand to Mr. Bimal Kumar, learned counsel, who has tendered appearance on behalf of the informant.

4. I find no reason to keep the present bail application pending.

5. Accordingly, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Katihar, in connection with Katihar Town P.S. Case No. 18 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

6. The parties must abide by the terms and conditions entered into between them, particularly, the petitioners, who have to return back the remaining amount to the informant within the period prescribed in the Memorandum of Agreement dated 19.09.2024. Upon failure of the same, the informant is at liberty to take appropriate action against the petitioners in
