JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code. As per the prosecution case, son of the informant went outside and he did not return leading to filing of the instant case.
Learned counsel for the petitioner submits that only after recovery of dead body of the victim, informant has raised suspicion against the petitioner and other accused persons. He submits that even as per the CDR, deceased had last time talked with one Dr. Aditya Singh. No substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case except
Patna High Court CR. MISC. No.39190 of 2021(3) dt.22-11-2021 2/2 suspicion. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has claimed clean antecedent and he is in custody since 12.2.2021. Charge sheet has already been submitted.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Darbhanga in Town Police Station Case No. 41 of 2021.
