The petitioners apprehend their arrest in Khanpur P.S. case No. 148/2017 under Section 120 (B), 201, 304(B)/34 of the Indian Penal Code.

The informant alleged that she married her daughter with son of the petitioners in the year 2016 but the accused persons were demanding a Motorcycle. Her daughter gave birth a male child but even thereafter the accused persons continued to torture her.

The learned counsel for the petitioner submits that the deceased died due illness on 05.10.2017 and her dead body was cremated with consent of all her relatives. The complaint

Patna High Court Cr.Misc. No.34066 of 2018 (2) dt.28-06-2018 2/2 petition was filed on 17.10.2017 on the basis of which the FIR was lodged. The petitioners are father in law and mother in law of the deceased and there is no allegation against the petitioners for demand of dowry and torture.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Samastipur, in connection with Khanpur P.S. case No. 148/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
