JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Aurai P.S. Case No. 37 of 2013, dated 12.04.2013, instituted for the offences punishable under Sections 363 and 366-A/34 of the Indian Penal Code. The petitioner is said to have abducted the daughter of the informant for the purposes of marrying her. During the course of investigation, it came to light that the victim/daughter of the informant is 24 years of age. She has disclosed in her 164 Cr.P.C. statement that she had married the petitioner of her own volition without being
Patna High Court Cr.Misc. No.33413 of 2018 (2) dt.03-07-2018 2/2 pressurized by him on any count. She has also declared in the aforesaid statement that when she got married to the petitioner, she was 19 years of age.
Considering the aforesaid facts, the daughter of the informant was later released by the court below in favour of the mother of the petitioner. The daughter of the informant wishes to stay as legally wedded wife of the petitioner in her matrimonial home.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Aurai P.S. Case No. 37 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
