The petitioner is in custody in connection with Hajipur Town P.S. Case No. 865 of 2016 for the offences under Sections 452, 382, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 17.02.2017. He further submits that petitioner was not named in the F.I.R. and other similarly circumstanced co-accused namely Gautam Kumar Singh @ Gautam Kumar and Prince Kumar @ Abhijeet Kumar have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 43364 of 2018 and Cr. Misc. No. 30520 of 2019 vide order dated 31.07.2018.
Considering the facts that similarly circumstanced co-

No.27692 of 2019(2) dt.26-04-2019 2/2 accused have been granted bail by Co-ordinate Bench of this Court and petitioner has remained in custody for more than two years, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Hajipur Town P.S. Case No. 865 of 2016.
