The petitioner apprehends his arrest in Excise Case No.8 of 2013 registered under Section 47(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the prayer for anticipatory bail of the petitioner was earlier rejected by order dated 13.02.2019 passed in Cr. Misc. No.7732 of 2019 but no recovery was made from the conscious possession of the petitioner. It is further submitted that of course the case is of the year 2013 but no process etc. under Sections 82 and 83 Cr.P.C. was exhausted. Other accused person namely, Chandan Sah has already been granted anticipatory bail by order dated 05.01.2015 passed in Cr. Misc. No.51841 of 2014.

Patna High Court CR. MISC. No.28716 of 2019(2) dt.17-07-2019 2/2 It appears that 1680 liters of spirit meant for manufacturing liquor was recovered from the semi constructed house of the petitioner. The motorcycle of the petitioner was also recovered from there. The petitioner was found fleeing away from the place of occurrence and on consideration of such facts, the prayer for anticipatory bail of the petitioner was earlier rejected.

I do not find any new ground to reconsider the prayer for anticipatory bail of the petitioner. Accordingly, the same is rejected.
