JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 29-01-2019 Petitioner has preferred his appeal against the order dated 26.04.2013 issued by the Superintendent of Police, Ara, Bhojpur inflicting the punishment of two black marks and withholding all benefits other than subsistence allowance for the said period. Appeal is Annexure 5 to the writ petition. Though appeal has been filed on 15.12.2014, no decision has been taken on the same till date.
In view of the same, the writ petition need not be kept pending as the appeal is yet to be decided by the appellate authority.
Counsel for the State submits that from the copy of appeal Annexure 5 it is not apparent that the same has been submitted
Patna High Court CWJC No.5490 of 2015 dt.29-01-2019 2/2 before any authority as it bears no receipt before any authority. The appeal is part of the writ petition and have been filed before the respondent no. 2. Since the copy has been annexed with the writ petition, this Court would dispose off the writ petition to enable the respondent no. 2 to take a final decision on the appeal expeditiously and in accordance with law within a period of three months from the date of receipt/production of a copy of this order.
