JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-07-2018 The petitioner seeks bail in anticipation of her arrest in connection with Chautham P.S. Case No. 23 of 2018, dated 13.02.2018, instituted for the offences punishable under Sections 147, 186, 224, 225, 232, 341, 323, 353, 504 and 506 of the Indian Penal Code. One Amar Kumar, an accused of Chautham P.S.
Case No. 23 of 2018, was attempted to be arrested by the police party; when with the intervention of the petitioner and others, he was made to escape from the net of the police. Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.33362 of 2018 (2) dt.04-07-2018 2/2 that apart from the fact that she is a woman, she had got no concern with the affairs of the accused of Chautham P.S. Case No. 23 of 2018. The petitioner and her husband have been made accused in this case only because the aforesaid accused/Amar Kumar was taking tea near the house the petitioner. The aforesaid accused could manage to make good his escape and only because the attempt of the police party to arrest him failed, several persons of the village were made accused including the petitioner.
Regard being had to the aforesaid facts as also that the petitioner does not have any criminal antecedent, this Court is inclined to enlarge her on anticipatory bail. Let the petitioner, above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Khagaria in connection with Chautham P.S. Case No. 23 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
