Petitioner apprehends his arrest in Dhanha P.S. Case No.183 of 2018, registered under Sections 272, 273 and 414 of the Indian Penal Code as well as under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The police intercepted two vehicles and arrested Vijay Singh and Bittu Kushwaha. From the vehicle of Vijay Singh, 120.960 litres of liquor and from the vehicle of Bittua Kushwaha, 80 litres of liquor was recovered. Vijay Singh and Bittu Kushwaha are said to have disclosed that the petitioner and other accused persons are their partners and they used to transport liquor from Uttar Pradesh to Bihar.
Learned counsel for the petitioner submits that save and except the so called disclosure made by Vijay Singh and Bittu
Patna High Court CR. MISC. No.27520 of 2019(2) dt.26-04-2019 2/2 Kushwaha, there is nothing on record to connect the involvement of the petitioner in the alleged transportation of liquor. Petitioner has got no criminal antecedent.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Dhanha P.S. Case No.183 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
