Since the issue is confined to validity of selection of Anganwari Sevika namely respondent No. 5 for Center No. 141 on the ground of respondent No. 5 not being a resident of Ward No.9, the parties agree that they would appear before the Appellate Authority, Deputy Director, Welfare, Saran Division, Chapra on 10.6.2019 along with copy of contemporaneous residence certificate in support of their candidature for Ward No. 9.
It will be open to the Deputy Director, Welfare, Saran
Patna High Court CWJC No.12728 of 2014(3) dt.06-05-2019 2/2 Division, Chapra to take a final decision in respect of validity of selection on contemporaneous residence certificate issued by the competent authority as contemplated in Clause 4.5 of the Selection Guidelines.
Let final decision be taken expeditiously and without any undue delay by the Appellate Authority in accordance with law by a reasoned and speaking order. The order dated 25.6.2014 earlier issued by the Deputy Director, Welfare, would be subject to any finding that he may arrive upon appearance of the parties before him.
The writ petition stands disposed of.
