Petitioner apprehends arrest in connection with Kundwa Chainpur P.S. Case No. 78 of 2016 registered for the offence punishable under sections 498A, 406 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. As a matter of fact, the informant has earlier lodged a complaint with same set of allegations against this petitioner, in which this petitioner has been granted bail by a co-ordinate Bench of this Court vide Annexure-2/1. Except

Patna High Court CR. MISC. No.28521 of 2019(2) dt.02-05-2019 2/2 the aforesaid complaint case, petitioner is not accused in any other case.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran, in connection with Chainpur P.S. Case No. 78 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
