JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Akbarpur P.S. Case No. 36 of 2017, dated 27.02.2017, instituted for the offences punishable under Sections 366(A)/34 of the Indian Penal Code. The daughter of the informant is alleged to have been abducted/kidnapped by the petitioner, his father and his sister.
The victim girl, on her recovery, has given her statement under Section 164 Cr.P.C., in which she has admitted that she had married the son of the petitioner of her
Patna High Court Cr.Misc. No.33897 of 2018 (2) dt.05-07-2018 2/2 own choice because of existing relationship between them and also disclosed her age to be 19 years.
In support of the factum of majority of the victim girl, learned counsel appearing for the petitioner has brought on record the photocopy of the marks-sheet issued by the Bihar School Examination Board, where her date of birth is mentioned as 06.06.1998. In the aforesaid statement, the victim girl has declined to go to the house of her father and has expressed her desire to stay with the petitioner and his son.
Regard being had to the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 36 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
