JUSTICE SANJAY PRIYA ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and the State. The prayer for anticipatory bail of the petitioner was earlier dismissed as withdrawn by this Court vide order dated 30.8.2017 passed in Cr. Misc. 39093 of 2017, on the prayer of the petitioner , that he may surrender before the court below and make prayer for regular bail.

Now, a fresh anticipatory bail application has been filed on behalf of the petitioner on the ground that one of the coaccused has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 14.12.2017 passed in Cr. Misc. 60295 of 2017.

The petitioner has earlier sought permission to withdraw the case as mentioned above to surrender before the

Patna High Court Cr.Misc. No.61493 of 2017 (2) dt.03-01-2018 2/2 court below and make prayer for regular bail and his case has already been dismissed as withdrawn. Therefore, this Court does not find any merit in the application.

The application stands dismissed.

The petitioner may surrender before the court below and make prayer for regular bail.
