JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-08-2019 This application, for grant of anticipatory bail, arises out of Nawada P.S. Case No. 125/18, disclosing offences under Sections 419, 420, 468, 467/34 of the Indian Penal Code and Section 3(10) of Bihar Examination Act, 1981. Prosecution case is that one person was found appearing in the examination in place of the petitioner and the admit card of the petitioner was also found from him. Submission of learned counsel for the petitioner is that as a matter of fact, the admit card of the petitioner was lost as such, he could not appear in the examination. However, learned counsel for the petitioner failed to satisfy as to why he did not complain the same or made effort to obtain another admit card.

No.34248 of 2019(3) dt.20-08-2019 2/2 Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, if possible on same day, without being prejudiced by this order. This application is, accordingly, dismissed.
