The petitioner seeks regular bail in connection with Jankinagar P.S. Case No. 198 of 2020 for the offence registered under Sections 25(1-b)a, 26 and 35 of the Arms Act. The allegation is regarding the police force having reached at the house of the petitioner whereafter search was conducted and one loaded pistol and one country made pistol along with ammunition was recovered from the room of the father of the petitioner. As far as the petitioner is concerned, nothing is stated to have been recovered form his room. The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case and he is languishing in custody since 12.12.2020.
Patna High Court CR. MISC. No.38959 of 2021(2) dt.25-01-2022 2/2 The learned counsel for the petitioner has further submitted that as far as the petitioner is concerned, no arms have been recovered from his conscious possession and nothing has been recovered from the room of the petitioner.
Per contra, the learned counsel for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also considering the fact that arms have not been recovered from the petitioner but the same have been recovered from the room of his father, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Purnea in connection with Jankinagar P.S. Case No. 198 of 2020. (Mohit Kumar Shah, J) S.Sb/- U T
